What "complete review" means

A complete review is one where we have processed all materials you submitted: your intake form, all documents uploaded to your case, and all emails forwarded to your case email address. We read everything before making a viability determination. We do not issue a NOT VIABLE determination based on an incomplete submission.

If your submission is missing materials that are necessary to make a determination, we will tell you what we need before the review is finalized. The 24-to-48-hour turnaround begins once we have a complete submission, not at the moment of payment.

What a viable case actually requires

A case is viable when at least one of the following is supported by the documentation you've provided:

  • Your HOA, condo association, or property management company imposed a rule, fee, or restriction that conflicts with Illinois state law
  • Your board skipped a required step (notice, hearing, voting threshold) before taking action against you
  • An unauthorized charge or ledger discrepancy you can document, including assessments imposed without the required process
  • A property manager licensed by IDFPR is acting in ways their license prohibits, including misrepresented billing or ignored records requests

Meeting one of these thresholds does not guarantee a favorable outcome from your HOA, condo association, or property management company. Viability means we have found a legitimate basis for a formal dispute. What happens after you send a letter depends on facts and conduct outside our control.

What the guarantee does not cover

The Viability Guarantee covers the viability determination only. It does not apply in the following circumstances:

  • Your submission was incomplete in a way that prevented a full assessment. We will always ask for what we need before finalizing a determination, so this should not arise. If it does, we will tell you clearly what the gap was.
  • Your dispute falls outside Illinois jurisdiction. DispuPoint covers Illinois homeowners only. If your property is located outside Illinois, the guarantee does not apply and we will notify you before any review begins.
  • You request a refund after you have received and reviewed a completed demand letter. Once the letter has been delivered to your portal and you have reviewed it, the service has been rendered.

How refunds are processed

When a case is determined to be NOT VIABLE, the refund is issued to the original payment method used at checkout. Refunds typically appear within 5 to 10 business days, depending on your card issuer. You will receive an email confirming the refund and including the written explanation of the determination.

If you have not received your refund after 10 business days, contact us and we will investigate with our payment processor.

If you believe the determination is incorrect

If you received a NOT VIABLE determination and believe we missed something or that additional documentation changes the picture, contact us. Send the additional materials and a brief explanation of what you believe was not considered. We will re-review at no charge. If the re-review results in a VIABLE or POTENTIALLY VIABLE determination, we proceed from that point. If it does not, the original determination stands and the refund remains in place.
